A. WEBSITE TERMS OF USE AND DISCLAIMERS
Welcome to the ninemillion.org or affiliated website (the "Site") which is owned and operated by the Office of the United Nations High Commissioner for Refugees ("UNHCR"). The use of the Site constitutes agreement with the following terms and conditions:
(1) UNHCR maintains the Site as a courtesy to those who may choose to access the Site ("Users"). The information presented herein is for informative purposes only. To the extent that it owns the respective copyrights, UNHCR grants permission to Users to visit the Site and to download and copy the information, documents and materials (collectively, "Materials") from the Site for the User's personal, non-commercial use, without any right to resell or redistribute them or to compile or create derivative works therefrom, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific Material within this Site. Users must keep all copyright and other proprietary notices attached to any downloaded Material. Any unauthorized use of the UNHCR and/or United Nations name, visibility logo and/or emblem is prohibited under international law.
(2) Unless expressly stated otherwise, the findings, interpretations and conclusions expressed on this Site do not necessarily represent the views of UNHCR, the United Nations or its Member States.
(3) Materials provided on this Site are provided "as is", without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. UNHCR specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials.
(4) UNHCR periodically adds, changes, improves or updates the Materials on this Site without notice.
(5) Neither UNHCR nor its affiliates, nor any of their respective agents, employees, information providers or content providers, shall be liable to any User or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting therefrom.
(6) The use of this Site is at the User's sole risk. Under no circumstances, including but not limited to negligence, shall UNHCR or its affiliates be liable for any direct, indirect, incidental, special or consequential damages, even if UNHCR has been advised of the possibility of such damages.
(7) The User specifically acknowledges and agrees that UNHCR is not liable for any conduct of any User.
(8) This site may contain advice, opinions and statements of various Users or information providers. UNHCR does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any information provider, any User of this Site or any other person or entity. Reliance upon any such advice, opinion, statement, or other information shall also be at the User's own risk.
(9) As a condition of use of this Site, the User agrees to indemnify UNHCR and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of the User's use of this Site, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms and Conditions. If the User is dissatisfied with any Material on this Site or with any of its Terms and Conditions of Use, the User's sole and exclusive remedy is to discontinue using the Site.
(10) This Site may contain links and references to third-party websites. The linked sites are not under the control of UNHCR, and UNHCR is not responsible for the content of any linked site or any link contained in a linked site. UNHCR provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by UNHCR.
(11) UNHCR reserves the right to modify or amend these Terms without notice at any time, and such modification will be effective upon posting by UNHCR on the Site. You agree to be bound by any changes to these Terms when you use the Site after any such modification is posted.
B. COMMUNITY TERMS OF USE AND DISCLAIMERS
In addition to the Terms of Use of the Site, If you wish to become a Member, communicate with other Members and make use of the ninemillion.org Community services (the "Service"), please read this Agreement and indicate your acceptance by following the instructions in the Registration process.
This Agreement sets out the legally binding terms for your use of the Site and your Membership in the Service.
(1) By using the Site and the Service, you represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are 13 years of age or older and that your use of the Service shall not violate any applicable law or regulation. Membership in the Service is void where prohibited. Your profile may be deleted without warning, if it is found that you are misrepresenting your age. Your Membership is solely for your personal use, and you shall not authorize others to use your account, including your profile or email address. You are solely responsible for all Content published or displayed through your account, including any email messages, and for your interactions with other Members.
(2) You are solely responsible for the content of any information you submit to the Service. Please choose carefully the information you post on the Service and that you provide to other Members. Any photographs posted by you may not contain nudity, violence, offensive or otherwise inappropriate subject matter. Information provided by other Members (for instance, in their profile) may contain inaccurate, inappropriate or offensive material, products or services and UNHCR assumes no responsibility nor liability for this material. You understand and agree that UNHCR may review and delete any content, messages, photos or profiles (collectively, "Content") that in the sole judgment of UNHCR violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person.
(3) You must use the Service in a manner consistent with any and all applicable laws and regulations, including these Terms. By way of example and not as a limitation, the Member agrees that when using the Service, he or she shall not do any of the following:
- (a) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
- (b) Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
- (c) Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the Member owns or controls the rights thereto or has received all consents therefor as may be required by law;
- (d) Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another's computer;
- (e) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
- (f) Falsify the origin or source of software or other material contained in a file that is uploaded;
- (g) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another Member of the Service that the Member knows, or reasonably should know, cannot be legally distributed in such manner;
- (h) Use the Service for the purpose of soliciting passwords or personal identifying information for commercial from other Members;
- (i) Transmit "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
- (j) Use the Service in an automated manner, such as using scripts to add friends;
- (k) Use the account, username, or password of another Member at any time, or disclose your password to any third party or permit any third party to access your account, or attempt to impersonate another Member or person who is not a Member of the Service.
(4) UNHCR reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including email) by you, or to restrict, suspend, or terminate your Membership and/or your access to all or any part of the Site and/or the Service at any time, or to alter, limit or discontinue the Site, the Service or any Materials in any respect. for any or no reason, with or without prior notice, and without liability.
(5) By posting any Content on the public areas of the Service, you grant to UNHCR the non-exclusive, royalty-free, worldwide license to use, publicly perform and display such Content on the Site. This license will terminate at the time you remove such Content from the Service.
(6) This Agreement shall remain in full force and effect while you use the Site, the Service, and/or are a Member. You may terminate your Membership at any time. UNHCR may terminate your membership for any reason, effective upon sending notice to you at the email address you provide in your Membership application or other email address as you may subsequently provide to UNHCR.
(7) UNHCR is not responsible for any incorrect or inaccurate Materials posted on the Site or in connection with the Service provided, whether caused by users of the Site, Members or by any of the equipment or programming associated with or utilized in the Service. UNHCR is not responsible for the conduct, whether online or offline, of any user of the Site or Member of the Service. UNHCR assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication. UNHCR is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including any injury or damage to Users and/or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the Site and/or in connection with the Service. The Site and the Service are provided "as is" and UNHCR expressly disclaims any warranty of fitness for a particular purpose or non-infringement. UNHCR cannot guarantee and does not promise any specific results from use of the Site and/or the Service.
(8) As a condition of use of this Service, you agree to indemnify UNHCR and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of the your use of the Service. If you are dissatisfied with any part of the Service, including any Material on this Site or with any of its Terms and Conditions of Use, your sole and exclusive remedy is to discontinue using the Service.
(9) Nothing herein shall constitute or be considered to be a limitation upon or a waiver of the privileges and immunities of UNHCR, which are specifically reserved.
(10) Any dispute regarding the use of the Site or the Service, or regarding these Terms, shall be resolved by means of non-judicial arbitration
(11) UNHCR may modify this Agreement from time to time and such modification shall be effective upon posting by UNHCR on the Site. You agree to be bound to any changes to this Agreement when you use the Service after any such modification is posted.
(12) This Agreement is accepted upon your use of the Site and is further affirmed by you becoming a Member of the Service. This Agreement constitutes the entire agreement between you and UNHCR regarding the use of the Site and/or the Service. The failure of UNHCR to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
